When Mediation May Fit a Family Law Dispute
Mediation may be appropriate when both parties are willing to exchange information and discuss possible settlement terms. It can address an entire divorce or focus on specific disagreements preventing the parties from reaching an agreement.
Issues commonly discussed during mediation include:
- Parenting time: Schedules for regular weeks, holidays, school breaks, and transportation.
- Legal custody: Authority to make major decisions concerning a child’s education, health care, and general welfare.
- Child support: Proposed support terms and financial information relevant to the calculation.
- Property division: Allocation of real estate, personal property, retirement accounts, and debts.

How Kansas Family Law Mediation Works
Under Kansas law, a neutral mediator helps the parties identify issues, clarify priorities, reduce misunderstandings, and explore possible compromises. The mediator doesn’t impose a decision. Any agreement results from the parties’ own choices.
The number of sessions depends on the number and complexity of the disputed issues. Some matters focus on a single parenting question, while others involve custody, support, property, and debt. If the parties reach an understanding, the terms should be put in writing and handled through the legal process that applies to the case. Under Kansas law, an agreement reached through mediation isn’t binding or admissible in court until it is put in writing, signed by the parties, and approved by the court. We review proposed settlement language so our clients understand their obligations and know which issues, if any, remain unresolved.
How Mediation Fits the Sedgwick County Court Process
