There are three types of protection from abuse orders in Kansas:
- Emergency protection from abuse order, which the victim requests when he or she is in immediate danger, and the courthouse is closed. This is valid until 5 pm on the next day that the courthouse is open.
- Temporary protection from abuse order, which is granted based on the victim’s testimony and lasts until the hearing for a permanent order takes place.
- Final protection from abuse order, which is only issued by the court after a hearing in which both sides present their case. The final order can last up to one year, but the court can extend it under certain conditions.
What a Protection from Abuse Order Can Do
Because a protection from abuse order can take many forms, it is important to have an experienced family law attorney in Wichita to represent your case.
A protection order can order one party not to abuse or molest the other, order the abuser to leave a shared home, require the abuser to provide alternate housing for the victim and any children, establish temporary child custody and visitation, and more.
