Compensation & Shared Fault After a Motorcycle Collision

An injury claim may seek economic, non-economic, and punitive damages. The compensation available depends on the evidence, the extent of the injuries, the losses connected to the collision, and how fault is allocated.

Compensation may include:

  • Economic damages: These address measurable financial losses such as medical bills, lost wages, and damage to the motorcycle.
  • Non-economic damages: These address pain and suffering and other effects that don’t have a direct dollar value.
  • Punitive damages: An injured person may pursue these damages in qualifying circumstances, but they’re rarely awarded.

Modified Comparative Negligence in Kansas

Kansas uses modified comparative negligence, which assigns each involved person a percentage of fault. An injured person’s damages are reduced by that person’s assigned percentage. Someone found 50% or more at fault can’t recover compensation.

Shared-fault disputes require a case-specific evaluation. We assess the available information and explain how comparative negligence may affect the legal options rather than predicting a result before reviewing the evidence.

Kansas Rules That Can Affect a Motorcycle Claim

Kansas Statute 8-1598 sets age-based helmet requirements and specific rules for motorcycle eye protection. The requirements vary based on the rider’s age, whether the person is an operator or passenger, and whether the motorcycle has a qualifying windscreen.

The statute provides the following requirements:

  • Helmets for minors: Operators and passengers under age 18 must wear helmets that comply with minimum National Highway Traffic Safety Administration guidelines.
  • Helmets for adults: Operators and passengers age 18 or older aren’t required by Kansas Statute 8-1598 to wear helmets.
  • Operator eye protection: Operators must wear qualifying eye protection unless the motorcycle has a qualifying windscreen measuring at least 10 inches tall from the center of the handlebars.
  • Passenger eye protection: Passengers under age 18 must wear eye protection.

Helmet use or eye-protection compliance doesn’t automatically determine fault, damages, or insurance coverage. Those issues depend on the circumstances of the collision and the arguments raised by the parties.

Two-year filing period: Kansas Statute 60-513 generally provides two years from the date of an accident to file an injury lawsuit. We evaluate that deadline early because investigating the claim, obtaining records, and preparing a demand all take place before litigation may begin.

How We Handle a Motorcycle Accident Claim

Our process moves from immediate medical care and claim preparation to litigation when a fair offer isn’t made. We explain the purpose of each stage so clients can make informed decisions.

The main stages include:

  • Prompt medical attention: The process begins with obtaining medical attention for injuries caused by the crash.
  • Pre-suit claim preparation: We collect records and prepare a demand that presents the claim to the appropriate party before filing a lawsuit.
  • Insurance claim negotiation: We assess responses and offers against the information supporting the claimed injuries and losses.
  • Litigation: If no fair offer is made, the case can proceed through discovery, motions, and trial in Sedgwick County District Court. Discovery is the formal exchange of relevant information between the parties.

We typically handle personal injury cases on a contingency fee basis, so attorney fees are due only when we recover compensation for the client. Our free 15-minute consultation offers an opportunity to discuss the collision and ask questions before deciding how to proceed.
